New York Court of Appeals Clarifies Term “Reside,” Affirms Summary Judgment in Lead Case

On April 5, 2016, the Court of Appeals of New York handed down a decision that clarifies the definition of “reside” as that term is used in Administrative Code § 27-2013[h][1] [Local Law 1], which governs a building owner’s duty to remove certain surface-coating material (e.g., lead) from the inside of apartment spaces.
